This website is hosted by an external service provider (host). Personal data collected on this website are stored on the servers of the host. The host is used for the purpose of fulfilling the contract with our potential and existing customers (Art. 6(1)(b) GDPR) and in the interest of secure, fast, and efficient provision of our online services by a professional provider (Art. 6(1)(f) GDPR). If appropriate consent has been obtained, the processing is carried out exclusively on the basis of Art. 6 (1)(a) GDPR and § 25 (1) TTDSG, insofar the consent includes the storage of cookies or the access to information in the user's end device (e.g., device fingerprinting) within the meaning of the TTDSG. Revocation of your consent to the processing of data

Rejection of unsolicited e-mails

We herewith object to the use of contact information published in conjunction with the mandatory information to be provided in our Site Notice to send us promotional and information material that we have not expressly requested. The operators of this website and its pages reserve the express right to take legal action in the event of the unsolicited sending of promotional information, for instance via SPAM messages.

We use the Usercentrics consent manager to obtain your consent to the storage of certain cookies or other technologies and to document your decision in accordance with data protection regulations. The provider is Usercentrics GmbH, Sendlinger Str. 7, 80331 Munich. 

When you visit our website, the following personal data is transmitted to Usercentrics: your consent or the revocation of your consent, your IP address, information about your browser and device, time of visit and geolocation. Usercentrics stores a cookie in your browser in order to be able to assign the consents you have given or their revocation.

Das Usercentrics-Banner wurde mit Hilfe von e-Recht24 konfiguriert. Um das Logo von eRecht24 anzuzeigen, wird eine anonymisierte Verbindung zum Bildserver von eRecht24 hergestellt. Der Bildserver von eRecht24 befindet sich in Deutschland bei einem deutschen Anbieter. 

Die Rechtsgrundlage zum Einsatz von Usercentrics ist Art. 6 Abs 1 li.c bzw. § 25 Abs. 1 TTDSGG. 

Analyse-Tools 

Diese Website benutzt den Open Source Webanalysedienst Matomo, den wir ausschließlich auf unseren eigenen Servern hosten, sodass alle Analysedaten bei uns verbleiben und nicht weitergegeben werden. 

Mit Matomo können wir die Websitebesucher erfassen und z.B. Seitenaufrufe und Logdateien wie IP-Adressen analysieren. Die Nutzung erfolgt nur nach Ihrer Einwilligung auf Grundlage von Art. 6 Abs. 1 lit. f DSGVO und § 25 Abs 1 TTDSG und ist jederzeit über das Consentmanagementsystem widerrufbar.

Server-Log-Dateien

Der Provider der Seiten erhebt und speichert automatisch Informationen in so genannten Server-Log-Dateien, die Ihr Browser automatisch an uns übermittelt. Dies sind:

  • Browsertyp und Browserversion
  • verwendetes Betriebssystem
  • Referrer URL
  • Hostname des zugreifenden Rechners
  • Uhrzeit der Serveranfrage
  • IP-Adresse

Eine Zusammenführung dieser Daten mit anderen Datenquellen wird nicht vorgenommen.

Die Erfassung dieser Daten erfolgt auf Grundlage von Art. 6 Abs. 1 lit. f DSGVO. Der Websitebetreiber hat ein berechtigtes Interesse an der technisch fehlerfreien Darstellung und der Optimierung seiner Website – hierzu müssen die Server-Log-Files erfasst werden.

Kontaktformular

Wenn Sie uns per Kontaktformular Anfragen zukommen lassen, werden Ihre Angaben aus dem Anfrageformular inklusive der von Ihnen dort angegebenen Kontaktdaten zwecks Bearbeitung der Anfrage und für den Fall von Anschlussfragen bei uns gespeichert. Diese Daten geben wir nicht ohne Ihre Einwilligung weiter.

Die Verarbeitung dieser Daten erfolgt auf Grundlage von Art. 6 Abs. 1 lit. b DSGVO, sofern Ihre Anfrage mit der Erfüllung eines Vertrags zusammenhängt oder zur Durchführung vorvertraglicher Maßnahmen erforderlich ist. In allen übrigen Fällen beruht die Verarbeitung auf unserem berechtigten Interesse an der effektiven Bearbeitung der an uns gerichteten Anfragen (Art. 6 Abs. 1 lit. f DSGVO) oder auf Ihrer Einwilligung (Art. 6 Abs. 1 lit. a DSGVO) sofern diese abgefragt wurde; die Einwilligung ist jederzeit widerrufbar.

Die von Ihnen im Kontaktformular eingegebenen Daten verbleiben bei uns, bis Sie uns zur Löschung auffordern, Ihre Einwilligung zur Speicherung widerrufen oder der Zweck für die Datenspeicherung entfällt (z. B. nach abgeschlossener Bearbeitung Ihrer Anfrage). Zwingende gesetzliche Bestimmungen – insbesondere Aufbewahrungsfristen – bleiben unberührt.

5. Verarbeiten von Daten (Kunden- und Vertragsdaten)

Wir erheben, verarbeiten und nutzen personenbezogene Daten nur, soweit sie für die Begründung, inhaltliche Ausgestaltung oder Änderung des Rechtsverhältnisses erforderlich sind (Bestandsdaten). Dies erfolgt auf Grundlage von Art. 6 Abs. 1 lit. b DSGVO, der die Verarbeitung von Daten zur Erfüllung eines Vertrags oder vorvertraglicher Maßnahmen gestattet. Personenbezogene Daten über die Inanspruchnahme dieser Website (Nutzungsdaten) erheben, verarbeiten und nutzen wir nur, soweit dies erforderlich ist, um dem Nutzer die Inanspruchnahme des Dienstes zu ermöglichen oder abzurechnen.

Die erhobenen Kundendaten werden nach Abschluss des Auftrags oder Beendigung der Geschäftsbeziehung gelöscht. Gesetzliche Aufbewahrungsfristen bleiben unberührt.

6. Datenübermittlung an CRIFBÜRGEL

Wir übermitteln im Rahmen dieses Vertragsverhältnisses erhobene personenbezogene Daten über die Beantragung, die Durchführung und Beendigung dieser Geschäftsbeziehung sowie Daten über nicht vertragsgemäßes Verhalten oder betrügerisches Verhalten an die CRIF Bürgel GmbH, Radlkoferstraße 2, 81373 München.

Rechtsgrundlagen dieser Übermittlungen sind Artikel 6 Absatz 1 Buchstabe b und Artikel 6 Absatz 1 Buchstabe f der Datenschutz-Grundverordnung (DSGVO). Übermittlungen auf der Grundlage von Artikel 6 Absatz 1 Buchstabe f DSGVO dürfen nur erfolgen, soweit dies zur Wahrung berechtigter Interessen unseres Unternehmens oder Dritter erforderlich ist und nicht die Interessen oder Grundrechte und Grundfreiheiten der betroffenen Person, die den Schutz personenbezogener Daten erfordern, überwiegen. Der Datenaustausch mit der CRIFBÜRGEL dient auch der Erfüllung gesetzlicher Pflichten zur Durchführung von Kreditwürdigkeitsprüfungen von Kunden (§ 505a und 506 des Bürgerlichen Gesetzbuches).

Die CRIFBÜRGEL verarbeitet die erhaltenen Daten und verwendet sie auch zum Zwecke der Profilbildung (Scoring), um ihren Vertragspartnern im Europäischen Wirtschaftsraum und in der Schweiz sowie ggf. weiteren Drittländern (sofern zu diesen ein Angemessenheitsbeschluss der Europäischen Kommission besteht) Informationen unter anderem zur Beurteilung der Kreditwürdigkeit von natürlichen Personen zu geben.
